Hengki M. Sibuea

Hengki is a Partner of Foster Legal and co-head its Commercial Litigation, Antitrust and Insolvency Practice Group. He specialises in complex commercial litigation, financial services litigation, regulatory investigations, commercial arbitration, insolvency and restructuring, anti-trust and employment law matters. He has over 18 years of extensive experience in those areas during which he spent years as Senior Associate in Dispute Resolution Practice Group at a prominent corporate law firm affiliated to one of the largest global law firms.

Hengki frequently acts for market-leading clients on their business-defining disputes across banking, retail, healthcare, manufacturing, oil and gas, fintech, telco and insurance industries. His diverse client base includes domestic and multinational banks, large State-Owned Enterprises, global companies, major local corporations and foreign institutional investors operating in Indonesia.

His approach is to achieve practical and commercially sound solutions for his clients, addressing the many and varied issues in those industries confronting entrepreneurs and investors when doing business in Indonesia's dynamic and increasingly complex business, investment and regulatory landscapes. In one of his major credentials, he was deployed by one of the largest global banks operating in Indonesia to act as the counsel in the submission of bankrupty petition against its debtors at several commercial courts in Indonesia. In another high-profile insolvency-related mandate, Hengki successfully represented one of largest telco companies in Indonesia at the Supreme Court in defending the client against bankruptcy applications filed by its suppliers.

Hengki's deep expertise in the alternative dispute resolution of complex contractual disputes was demonstrated when he advised and successfully represented a major US-based oil and gas corporation at the Indonesian National Arbitration Board in connection with the default on the construction of oil and gas pipelines. His prominence in the arbitration arena, having resolved high-profile disputes through the Indonesian National Arbitration Board, was further showcased when he represented a subsidiary of Europe-based global retailer in a sensitive construction-related dispute, and also a local insurance company in several cases related to claims of insurance fraud filed at the Indonesian National Arbitration Board, successfully secured arbitral awards in favor of his client.

In addition to his proven track records and credentials in commercial and financial services litigations, insolvency, commercial arbitration and employment laws, one of Hengki's strongest forte is antitrust law where he recently completed his Doctor of Law (Ph.D) study in Antitrust Law at the University of Pelita Harapan, aside from his hands-on involvement in major antitrust-related cases to represent his clients.
