Marco is an Associate in the firm's Banking, Finance and Fintech Practice Group. With a real strength in corporate and project finance, he acts for both borrowers and lenders in a variety of secured and unsecured corporate finance transactions and project financing arrangements, including those with cross-border and cross-currency features.
His clients range from State-Owned Enterprises, commercial banks, fintech investors to venture capital and asset management companies. At Foster, he advises a wide array of foreign banks on the extension of multi-purposes secured financing to Indonesian entities in the mining and manufacturing sectors. He also regularly counsels fintech companies (digital lending, crypto trading and payment services) in relation to their market entry, product structuring, compliance work and regulatory engagements.
Marco has extensive experience in advising clients on the structuring, drafting and negotiation of a broad range of project and finance documents, including the full suite of finance documents for limited and non-recourse project financings in the energy, transportation, infrastructure, mining and manufacturing sectors, including emerging areas such as data center and solar photovoltaic. Clients also have sought him out for guidance on the full spectrum of acquisitions and disposals, from initial due diligence, transaction structuring and contract negotiation to completion and post-transaction support.
Among key highlights of his transactional experience in financing transactions, Marco assisted PT TBS Energi Utama Tbk in connection with the project financing for the Tembesi Floating Solar Power Plant (PLTS Terapung Tembesi) in Batam, a 46 MWp facility developed as a joint venture with PLN Nusantara Power, which is set to become one of Indonesia's largest floating solar projects. He also counseled PT Indointernet Tbk and its subsidiary PT Ekagrata Data Gemilang as joint borrowers in connection with a IDR 5.5 trillion credit facility for the financing of the EDGE2 data center construction and other general corporate needs of the borrower.
Marco is further tasked by the Partners of Foster to support the rapid growth of the firm's China Desk, particularly in the context of financing and fintech-related regulatory compliance, developments and licensing matters. He advises Export-Import Bank of China (Guangdong Branch) on the provision of asset-backed financing facilities to an Indonesia-based manufacturer and exporter of coconut products. He also acts as regulatory counsel to various multinational fintech companies to comply with the regulations of Indonesia's Central Bank and the Financial Services Authority for their expansions, corporate governance, product launch, licensing and procurement of approvals, data privacy, strategic alliances and ecosystem partnership.
